Robert Abrams argues that new concepts of space and landscape emerged in mid-nineteenth-century American writing, marking a linguistic and interpretative limit to American expansion. Abrams supports the radical elements of antebellum writing, where writers from Hawthorne to Rebecca Harding Davis disputed the naturalizing discourses of mid-nineteenth century society. Whereas previous critics find in antebellum writing a desire to convert chaos into an affirmative, liberal agenda, Abrams contends that authors of the 1840s and 50s deconstructed more than (...) they constructed. One controversy about the existence of so called evolutionary forces such as natural selection and random genetic drift concerns the sense in which such “forces” can be said to interact. In this paper I explain how natural selection and random drift can interact. In particular, I show how population-level probabilities can be derived from individual-level probabilities, and explain the sense in which natural selection and drift are embodied in these population-level probabilities. I argue that whatever causal character the individual-level probabilities (...) have is then shared by the population-level probabilities, and that natural selection and random drift then have that same causal character. Moreover, natural selection and drift can then be viewed as two aspects of probability distributions over frequencies in populations of organisms. My characterization of population-level probabilities is largely neutral about what interpretation of probability is required, allowing my approach to support various positions on biological probabilities, including those which give biological probabilities one or another sort of causal character. ‡This paper has benefited from feedback on and discussions of this and earlier work. When M. H. Abrams published a defense, in 1972, of "theorizing about the arts,"1 some of his critics accused him, of falling into subjectivism. He had made his case so forcefully against "the confrontation model of aesthetic criticism," and so effectively argued against "simplified" and "invariable" models of the art work and of "the function of criticism," that some readers thought he had thrown overboard the very possibility of a rational criticism tested by objective criteria. In his recent reply (...) to these critics,2 Abrams concentrates almost entirely on whether his critical pluralism is finally a skeptical relativism. He does not even mention his great historical works, The Mirror and the Lamp and Natural Supernaturalism, and he has nothing to say about how his pluralistic theories would be applied to the writing of history. But then, surprising as it seems once we think about it, neither of the two histories has much about his method either. What is the true achievement of these aggressive raids into our past, and how does Abrams see them in relation to other possible histories of the same subjects? Throughout the animal kingdom, p53 genes function to restrain mobile elements and recent observations indicate that transposons become derepressed in human cancers. Together, these emerging lines of evidence suggest that cancers driven by p53 mutations could represent “transpospoathies,” i.e. disease states linked to eruptions of mobile elements. The transposopathy hypothesis predicts that p53 acts through conserved mechanisms to contain transposon movement, and in this way, prevents tumor formation. How transposon eruptions provoke neoplasias is not well understood but, from a broader (...) perspective, this hypothesis also provides an attractive framework to explore unrestrained mobile elements as inciters of late‐onset idiopathic disease.Also see the video abstract here. An accountability-based privacy governance model is one where organizations are charged with societal objectives, such as using personal information in a manner that maintains individual autonomy and which protects individuals from social, financial and physical harms, while leaving the actual mechanisms for achieving those objectives to the organization. This paper discusses the essential elements of accountability identified by the Galway Accountability Project, with scholarship from the Centre for Information Policy Leadership at Hunton & Williams LLP. Conceptual _Privacy by Design_ principles (...) are offered as criteria for building privacy and accountability into organizational information management practices. The authors then provide an example of an organizational control process that uses the principles to implement the essential elements. Initially developed in the ‘90s to advance privacy-enhancing information and communication technologies, Dr. Ann Cavoukian has since expanded the application of _Privacy by Design_ principles to include business processes. Abstractabstract:Vaccine hesitancy continues to pose a formidable obstacle to increasing national COVID-19 vaccination rates in the US, but this is not the first time that American vaccination efforts have confronted resistance and apathy. This study examines the history of US vaccination efforts against smallpox, polio, and measles, highlighting persistent drivers of vaccine hesitancy as well as factors that helped overcome it. The research reveals that logistical barriers, negative portrayals in the media, and fears about safety stymied inoculation efforts as early (...) as the 18th century and continue to do so. However, vaccine hesitancy has been markedly diminished when trusted community leaders have guided efforts, when ordinary citizens have felt personally invested in the success of the vaccine, and when vaccination efforts have been tied to broader projects to improve public health and social cohesion. Deliberately cultivating such factors could be an effective strategy for lessening opposition today, when COVID-19's distinctive characteristics make addressing vaccine hesitancy more urgent than it has ever been. The aim of UK-REACH (“The United Kingdom Research study into Ethnicity And COVID-19 outcomes in Healthcare workers”) is to understand if, how, and why healthcare workers (HCWs) in the United Kingdom (UK) from ethnic minority groups are at increased risk of poor outcomes from COVID-19. In this article, we present findings from the ethical and legal stream of the study, which undertook qualitative research seeking to understand and address legal, ethical, and social acceptability issues around data protection, privacy, and information (...) governance associated with the linkage of HCWs’ registration data and healthcare data. We interviewed 22 key opinion leaders in healthcare and health research from across the UK in two-to-one semi-structured interviews. Transcripts were coded using qualitative thematic analysis. Participants told us that a significant aspect of Big Data research in public health is varying drivers of mistrust—of the research itself, research staff and funders, and broader concerns of mistrust within participant communities, particularly in the context of COVID-19 and those situated in more marginalised community settings. However, despite the challenges, participants also identified ways in which legally compliant and ethically informed approaches to research can be crafted to mitigate or overcome mistrust and establish greater confidence in Big Data public health research. Overall, our research indicates that a “Big Data Ethics by Design” approach to research in this area can help assure (1) that meaningful community and participant engagement is taking place and that extant challenges are addressed, and (2) that any new challenges or hitherto unknown unknowns can be rapidly and properly considered to ensure potential (but material) harms are identified and minimised where necessary. Our findings indicate such an approach, in turn, will help drive better scientific breakthroughs that translate into medical innovations and effective public health interventions, which benefit the publics studied, including those who are often marginalised in research. This beginning, from the Preface entitled “Rorty’s ‘Violence of Direction’” to Chapter 1 entitled “From Pragmatism to Rortyism” occupies almost the first third, and seems to establish a three-part structure, of the book. What is guilt beyond a reasonable doubt (BARD) for a Bayesian? Is thinking of BARD in terms of probabilities a nonstarter? I propose an account of BARD compatible with Subjective Bayesianism that rejects the view that BARD is met by a threshold probability. BARD is a judgment, not merely about the credal state the factfinder endorses as her own (i.e. not merely as one’s own credence in guilt), but as about alternative possible credences, specifically those the factfinder does not endorse, (...) but finds reasonable. To this end, I employ a Bayesian framework, expounded by Lange (1999), that permits revision of past prior probability assignments. Such a framework presupposes a point of view free from one’s prior from which a prior is judged. A trier-of-fact asks whether doubt persists among any reasonable starting point one might take; if it does, acquittal is warranted. (shrink)

Causation is production, not dependence. It is not merely a matter of how two facts or events covary, but about what underlies that covariation. Furthermore, causation is unified (not fragmented or plural) and is a natural relation (in the world). To cause is to make something happen, to generate. The causal nexus (the web of causal influence) consists entirely of productive positive causes. With these fixed, the (causal) dependence relations are determined. -/- Dependence belongs to the theory of explanation. Causal (...) dependence is an explanatory notion: A causally explains B, in virtue of a causal relation between cause C and effect E. Confusing causation and explanation in this way underlies two related errors: the identification of omissions as causes and the embrace of causal pluralism. -/- A proper understanding of causation as production can better make sense, both of the metaphysics of causation itself, and of the special role that causation plays in explanation, responsibility, and rational planning. Each of these has a special causal species (causal explanation, causal responsibility, etc.), in which dependences play an important role, but one that is distinct from the role played by causation itself. -/- Morality and the law also attribute significance to causation, especially in terms of responsibility and liability. We are responsible for that which we cause. The law and common-sense morality both see an important distinction between active and omissive harming. Liability traditionally attaches more easily for active causing of harm than it does for omissions and failures to prevent harm (where the law requires a special duty). -/- A production theory of causation and an understanding of how omissions are not properly causal makes better sense of the role of causation in liability. This requires refinement, since, the law does, selectively, apply liability to omissions and preventions. Crucially, however, and on a view that identifies omissions as causes, puzzlingly, liability for omissions requires a preexisting duty to perform. My account explains the law’s differential treatment of proper causal liability and this latter omissive liability, and, in the process, offers a novel theory of non-causal liability in terms of corrective justice, that is dependence-driven, for cases involving omissions. I argue that cases of liability for omissions are cases in which the liability is not properly causal; rather, when a duty is owed by a defendant to a plaintiff, the defendant has a second-order duty in corrective justice to place the plaintiff in the position she would have been had defendant comported with his duty. As such, what the defendant owes is not the damage “caused” by the omission, but to make good on the obligation that the defendant owes to place the plaintiff in the position in which she has a right to be. The perception of separation between school and home/community is related to diminished achievement in school and lack of motivation to learn STEM subjects. The National Council of Educational Research and Training is among many research organisations that have strongly recommended that schools bridge the disconnect between school-based knowledge and learners’ everyday knowledge. We designed the SPIRALS curriculum to bridge this gap between formal science and students’ everyday lives. SPIRALS helps students explore community-based practices to learn about science, environmental sustainability and (...) systems thinking. We implemented the SPIRALS curriculum in a private, urban, English medium school in Western India with approximately 315 students and their four teachers, 214 of whom also participated in the research from which our conclusions are drawn. Our findings about program impacts rely upon analysis of interviews with teachers and students, as well as student work, and conference participation assessment surveys distributed after a capstone experience at which students present their work. This chapter describes our findings about how students learned science, environmental sustainability, and systems thinking through engagement with community-based practices. We also discuss the process of how the SPIRALS approach worked in India and how it could be expanded into a broader learning model across different socio-cultural contexts within India. (shrink)

Robert Card has proposed a reasonability view of conscientious objection that asks providers to state the reasons for their objection for evaluation and approval by a review board. Jason Marsh has challenged Card to provide explicit criteria for what makes a conscientious objection reasonable, which he claims will be too difficult a task given that such objections often involve contentious metaphysical or religious claims. Card has responded by outlining standards by which a conscientious objection could be judged reasonable. In (...) this paper, I extend Marsh’s critique to key concepts in the standards outlined by Card such as abortifacient, harm, emergency, and discrimination, showing they can be given radically different interpretations given different metaphysical or religious presumptions. To resolve these conflicting interpretations, a reasonability view of conscientious objection will need more than the criteria outlined by Card, it will need the resources to evaluate the reasonability of metaphysical or religious claims. Democratic theorists often place deliberative innovations such as citizen's panels, consensus conferences, planning cells, and deliberative polls at the center of their hopes for deliberative democratization. In light of experience to date, the authors chart the ways in which such mini-publics may have an impact in the “macro” world of politics. Impact may come in the form of actually making policy, being taken up in the policy process, informing public debates, market-testing of proposals, legitimation of public policies, building confidence and (...) constituencies for policies, popular oversight, and resisting co-option. It has been argued that biological fitness cannot be defined as expected number of offspring in all contexts. Some authors argue that fitness therefore merely satisfies a common schema or that no unified mathematical characterization of fitness is possible. I argue that comparative fitness must be relativized to an evolutionary effect; thus relativized, fitness can be given a unitary mathematical characterization in terms of probabilities of producing offspring and other effects. Analyses of factual causation face perennial problems, including preemption, overdetermination, and omissions. Arguably, the thorniest, are cases of omissive overdetermination, involving two independent omissions, each sufficient for the harm, and neither, independently, making a difference. A famous example is Saunders, where pedestrian was hit by a driver of a rental car who never pressed on the (unbeknownst to the driver) defective (and, negligently, never inspected) brakes. Causal intuitions in such cases are messy, reflected in disagreement about which omission mattered. What (...) these analyses mistakenly take for granted, is that at issue is the 'efficacy' of each omission. I argue, on the contrary, the puzzle of omissive overdetermination favors taking the act/omission distinction seriously. Factual causation, properly understood precludes omissions (i.e. omissions are not causal). Of course, the law also attaches liability to omissions, but this works differently from liability for real causes (e.g. omissions have a duty requirement, they also respond differentially to difference-making considerations). The manner in which liability attaches for omissions differs from that of straightforward causal liability, and is entirely dependent on the underlying causal structure. Attention to that structure (e.g. that the driver's hitting the pedestrian with his car is what actually caused the injury) sheds light on which omissions matter (e.g. driver's failure to press on the brakes) and why (because that failure removes a defense the driver would have to liability for the accident he caused). Other cases, where the parties' connection is entirely omissive (e.g. two physicians fail to detect independently lethal conditions), come out differently (tracking moralized elements). The analysis offered makes better sense of both why omissive determination cases are puzzling and how to resolve them. (shrink)

The VIA Classification of Strengths and Virtues is the most commonly used model of positive personality. In this study, we used two methods of model modification to develop models for two measures of the character strengths, the VIA Inventory of Strengths-Revised and the Global Assessment of Character Strengths. The first method consisted of freeing residual covariances based on modification indices until good fit was achieved. The second was residual network modeling (RNM), which frees residual partial correlations while minimizing a function (...) that penalizes more complex models. Models based on both strategies were developed for the two questionnaires. The resulting structural models were then applied to four other samples. Though both modification procedures achieved good fit in the sample used to develop the models, only RNM resulted in adequate model fit for both measures in all cross-validation samples. This finding suggests RNM is more robust against overfitting than traditional practices. Moreover, the result supports the validity of the three-factor model of character strengths with replicability. (shrink)

Public bioethics aims to provide moral guidance on questions of public policy, research, and clinical ethics. However, Alasdair MacIntyre famously opened his seminal work, _After Virtue_, with a ‘disquieting suggestion’ that contemporary moral language is in such a state of disorder that securing authoritative moral guidance will not be possible. In _Ethics After Babel,_ Jeffrey Stout responds to MacIntyre’s pessimistic description of contemporary moral discourse by developing the idea of _moral bricolage_, which involves taking stock of the ethical questions that (...) need answering, the available conceptual resources at hand from a variety of traditions (e.g., philosophies, theologies, law), and then reworking them to create a solution. In this essay, we draw upon MacIntyre’s insight about tradition and Stout’s metaphor of moral bricolage to argue that _some_ works of bioethical consensus are appropriately described as works of moral bricolage that, when analyzed, reveal theoretical insights about an emerging tradition of secular bioethics. A growing number of contributors to environmental philosophy are beginning to rethink the field’s mission and practice. Noting that the emphasis of protracted conceptual battles over axiology may not get us very far in solving environmental problems, many environmental ethicists have begun to advocate a more pragmatic, pluralistic, and policy-based approach in philosophical discussions abouthuman-nature relationships. In this paper, we argue for the legitimacy of this approach, stressing that public deliberation and debate over alternative environmental ethics is necessary for a (...) culture of democracy to be upheld in decision making and policy formulation. Then we argue for a democratically tempered environmental ethics that is grounded in a practical understanding of the character of moral claims regarding the natural world. We offer the results of an empirical study of environmental ethics held by the public to illustrate the diversity in their moral commitments to nature. Finally, we conclude with a discussion of the implications of this ethical pluralism for policy discussions about the management of American public lands. (shrink)

The rising prominence of “accountability” in public discourse has given rise in turn to a burgeoning of attention given to “accountability” in recent academic scholarship. It has been an object of scholarly debate and analysis in, for example, political science, public administration, international relations, social psychology, constitutional law, and business administration. However, in each of the sub disciplines, scholars analyze concepts of accountability and practices of account-giving unaware of, and still less building on, each other’s achievements. This introductory chapter to (...) the Oxford Handbook of Public Accountability provides a comprehensive overview of the current scholarship on public accountability. In the course of doing that, it will also provide an overview of recent work in accountability across various fields, illustrating some of the important commonalities and differences. It is argued that most researchers use fairly similar and reasonably comparable notions of what constitutes the core of accountability. (shrink)

We describe a case of parents refusing a tracheostomy for an otherwise healthy newborn. The refusal was not honored because permitting the refusal would have violated state law, which required a child to have a qualifying condition (e.g. a terminal diagnosis, permanent unconsciousness, incurable condition with severe suffering) to remove or withhold life-sustaining treatment. However, this case strained the relationship between the parents and medical staff, who worried about sending the newborn home with a tracheostomy where she was not wanted. (...) While many ethical issues arise in treatment refusal cases like this, we focus on the opportunity for ethicists to help the medical staff reflect on the technological alienation of the parents, which may help foster empathy, reduce moral distress, and strengthen the quality of the doctor-parent-patient triad. We demonstrate that social capital is associated with positive food security outcomes, using survey data from 378 households in rural Uganda. We measured food security with the Household Food Insecurity Access Scale. For social capital, we measured cognitive and structural indicators, with principal components analysis used to identify key factors of the concept for logistic regression analysis. Households with bridging and linking social capital, characterized by membership in groups, access to information from external institutions, and observance of norms in groups, (...) tended to be more food secure. Households with cognitive social capital, characterized by observance of generalized norms and mutual trust, were also more food secure than others. However, we established that social capital is, by itself, insufficient. It needs to be complemented with human capital enhancement. We recommend that development interventions which focus on strengthening community associations and networks to enhance food security should support activities which enhance cognitive social capital and human capital skills. Such activities include mutual goal setting, trust building and clear communication among actors. Education efforts for community members, both formal and non-formal, should also be supported such that they potentially strengthen social capital to improve food security in rural Uganda. (shrink)

O tema é discutido a partir de um outro conceito do mesmo autor, o de cisão da personalidade em verdadeiro e falso si-mesmo, com a ajuda de textos de Marion Milner em que esta questiona Winnicott acerca do isolamento e incomunicabilidade. Na sequência, é examinada a importância terapêutica do "objeto que sobrevive". Sobre este último (...) tema, é oferecida uma ilustração clínica.The article develops a reflection on Winnicott's concept of isolated self, to which are attributed characters of being permanently unknown and incommunicable. This topic is further discussed with the help of another concept of the same author, that of scision into the true and the false self, and of some texts by Marion Milner where Winnicott's ideas of isolation and incommunicability are questioned. In the sequence, the therapeutic significance of the "object which survives" is examined. To that end, a clinical exemple is presented and analized. (shrink)

Convergence research is driven by specific and compelling problems and requires deep integration across disciplines. The potential of convergence research is widely recognized, but questions remain about how to design, facilitate, and assess such research. Here we analyze a seven-year, twelve-million-dollar convergence project on sustainable climate risk management to answer two questions. First, what is the impact of a project-level emphasis on the values that motivate and tie convergence research to the compelling problems? Second, how does participation in convergence projects (...) shape the research of postdoctoral scholars who are still in the process of establishing themselves professionally? We use an interview-based approach to characterize what the project specifically enabled in each participant’s research. We find that (a) the project pushed participants’ research into better alignment with the motivating concept of convergence research and that this effect was stronger for postdoctoral scholars than for more senior faculty. (b) Postdocs’ self-assessed understanding of key project themes, however, appears unconnected to metrics of project participation, raising questions about training and integration. Regarding values, (c) the project enabled heightened attention to values in the research of a large minority of participants.
